1. This criminal appeal is preferred against the judgment dated 27.09.2006 passed by the Learned Judicial Magistrate (1st Class), 6th Court, Paschim Midnapur acquitting the accused for the offence punishable under Section 138 of the Negotiable Instruments Act in connection with C.R. Case No. 190 of 2003 (T.R. Case No. 166 of 2013).
2. Learned Advocate for the appellant has filed a written instruction from the appellant seeking permission to withdraw the instant criminal appeal. The prayer is allowed.
3. Accordingly, the instant criminal appeal is dismissed as withdrawn.
4. Lower court records along with a copy of this judgment be sent down at once to the Learned Trial Court for necessary action.
5. Photostat certified copy of this order, if applied for, be given to the parties on priority basis on compliance of all formalities. (Ananya Bandyopadhyay, J.)
