The grievance of the petitioner is that the CESC Limited is not giving new electricity connection to the petitioner despite the petitioner having applied for such connection duly.

Learned counsel appearing for the CESC Limited hands up a copy of an objection address to the petitioner, sent by the CESC Limited which indicates that the CESC apprehends the intention of splitting of load at the premises by virtue of taking such new connection. Since a specific dispute has been raised by the CESC Limited regarding apprehended splitting of load, such dispute can only be resolved by the concerned Grievance Redressal Officer under Clause 14 of the Regulation No.53 of the West Bengal Electricity Regulatory Commission.

In such view of the matter, WPA 6474 of 2022 is disposed of by granting liberty to the petitioner to

approach the concerned Grievance Redressal Officer (GRO) with the grievance as ventilated in the present writ petition.

If so approached, the said GRO shall decide the issue in accordance with law, upon giving adequate opportunity of hearing to all interested parties, without being influenced by any of the observations made herein. It is expected that the GRO shall decide the issue as expeditiously as possible, preferably within six weeks from the date of reference.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
