Kumar Das Mr. Mobaidur Hossain ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division) 1st Court at Berhampore, Murshidabad to dispose of Partition Suit No. 329 of 2022 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to serve a copy of this application along with a copy of this order upon the opposite party or their learned advocate representing them before the learned trial Judge.

It has been submitted by the learned advocate for the petitioner that several interlocutory applications including the application for injunction

are still pending. He further submits that June 9, 2025 has been fixed for hearing of the application for injunction.

In the light of the aforesaid submission of the learned advocate for the petitioner, CO 1073 of 2025 is disposed of by requesting the learned Civil Judge (Sr. Division) 1st Court, Berhampore, Murshidabad to dispose of the interlocutory application as expeditiously as possible, preferably on or before the end of July, 2025 without granting any unnecessary adjournments to either of the parties, if the same is otherwise ready for hearing.

After disposal of the interlocutory application the learned Civil Judge (Sr. Division) 1st Court Berhampore, Murshidabad shall make all endeavour to see that the suit being Partition Suit No. 329 of 2022 is disposed of expeditiously without granting any unnecessary adjournments to either of the parties.
