that the appellant is in custody for 500 days. Petitioner is innocent of charges and has been falsely implicated in connection with the instant case. It has additionally been contended that although the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 has been incorporated subsequently in the charge-sheet but the investigation was carried out by Sub-Inspector of Police. Additionally, it has been contended that there has been violation of the provisions of the POCSO Act and the time frame as is required under the said Act has not been adhered to by the learned trial court.

Learned advocate for the private opposite party/victim drew the attention of the Court to the evidence of the victim and her

parents.

Learned advocate for the State has produced the case diary and drew attention of the Court to the statement of the victim as also the medical examination report.

Having considered the factum of certain corroborations available from the materials produced before this Court, at this stage, I am not inclined to release the appellant on bail. Accordingly, the prayer for bail of the appellant in CRA(SB)106 of 2026 is dismissed.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
