These two writ petitions are taken up for analogous hearing and disposal due to similarity of the issue involved in the matters.
On behalf of the University of Calcutta, the affidavits-in-opposition to the writ petitions are filed, let those affidavits be taken on record.
The petitioners are Junior Superintendants of the University of Calcutta, they are alleging that 39 Senior Assistants have been given promotion to the post of Junior Superintendents with effect from April 01, 2015 thereby their seniority have been affected, inasmuch as the said 39 employees have become senior than the petitioners. The petitioners are praying restoration of their seniority.
Mr. Nilotpal Chatterjee, learned advocate for the University submits that the grievance of the petitioners has been addressed as their seniority have already been restored.
He further submits on instruction that the University has taken further steps for payment of the arrear dues of the petitioners with effect from April 01, 2015 and for the post of Senior Superintendents with effect from April 01 of 2020 after necessary adjustment of pay scale in accordance with law.
He files written instruction of his client dated March 19, 2023 to the said effect, let it be kept with the record.
In view of such development no further order(s) need be passed in these matters.
WPA 7016 of 2023 and WPA 7021 of 2023 are thus disposed of with the above terms without any order as to costs.
