Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 4 months and there has been hardly any progress in the case warranting further detention of the present petitioner. It has also been contended that the prosecution has relied upon 27 witnesses in order to prove its case which is not possible in near future, as such the petitioner may be released on bail.
Learned advocate for the State submits that an interstate racket was involved in selling of minor babies. To that effect, many persons in the chain have been arrested. Some are still absconding. Prosecution till date has completed 7 witnesses and the evidence of PW 8 is in progress. All efforts
are being exerted to complete the trial within a reasonable period of time. So far as the present petitioner is concerned, it has been contended that petitioner is not only one of the contact points, but is involved in procuring such child from the source. The racket which operates, are dangerous in nature and the prosecution is still investigating a part of the offence. Having considered the factum that the evidence of the case is in progress and already number of witnesses have been examined, I am not inclined to release the petitioner on bail having considered his complicity in the alleged offence. Accordingly, CRM (M) 773 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
