Mr. Islam, learned advocate appearing on behalf of the State respondents submits that although a communication was sent to the District Panchayats and Rural Development Officer (DPRDO), Murshidabad pursuant to the order of this Court on January 25, 2023, the DPRDO Murshidabad had not contacted Mr. Islam. No payment has been made to the petitioner pursuant to the measurements taken by the Pradhan.

The Block Development Officer forwarded the letter of the Pradhan to the DPRDO so that steps could be taken to release the payment in favour of the petitioner.

The learned advocate for the Pradhan also submits that the matter is pending before the District Panchayats and Rural Development Officer and the contention of the petitioner that the work had been completed, was found to be correct.

Under such circumstances, the writ petition is disposed of with a direction upon the District Magistrate,

Murshidabad to ensure that the DPRDO takes immediate steps for release of the admissible amount to the petitioner on the basis of the report filed by the Pradhan and the Block Development Officer. Such payment should be released within a period of six weeks from date of communication of this order.

If the District Magistrate detects that the DPRDO, Murshidabad had not made the payment in terms of this order, then the District Magistrate shall take stringent measures to ensure that the disbursement of the salary of the DPRDO Murshidabad be withheld, till the entire payment is made.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
