Petitioner is aggrieved by the fact that he claims to have a shop room since 2020 which was purchased by him. It is alleged that the private respondent along with certain miscreants have been trying to interfere with his regular business. A pre-emption suit was filed at the instance of the private respondent which was dismissed. Petitioner claims that the private respondents are bent upon to interfere with his possession and are trying to throw him away from the property.

Learned advocate for the State has submitted a report. It is stated in the report that against the dismissal of the pre-emption suit a Misc. Appeal has been preferred and which is pending

before the learned Additional District Judge, Fast Track Court, Ranaghat, Nadia.

Be that as it may, the nature of dispute is in respect of possession of a shop room. This court or the police authorities will not decide issues relating to right, title, interest and possession which is absolute domain of the civil court.

Police authorities however would ensure that there is no breach of the peace and/or tranquility and or any untoward incident resulting from the strained relationship existing between the parties.

With the aforesaid observations WPA 6849 of 2025 is disposed of.

Report so submitted be kept with the record.
