WPA 5910 of 2005 Madan Mohan Hudati and Ors.

Vs.

The State of West Bengal and Ors.

Mr. Rabindranath Mahato Mr. Satyendra Agarwal Mr. Animesh Paul ..for the petitioners After delivery of judgment the instant matter is listed under the heading "To Be Mentioned" at the instance of the petitioner. It is pointed out by the learned advocate for the petitioner that there are some typographical errors in the judgment. I also find the said typographical errors which has not been corrected in the judgment delivered on 17th August, 2023. For example, the spelling of the name of the advocate on record was wrongly recorded, secondly, the institution year of L.A. Case No. 9 (Act-II) of 1981-82 has been recorded as 1982-81. In some places Section 9 (3B) of the Land Acquisition West Bengal Amendment Act was recorded as 9(3b), bracketed portion of number of Section 9 (3B) was improperly recorded, in page 8 of the judgment

instead of sub-section section has been recorded, one of the L.A. Case No. has not been mentioned in paragraph 10 of the judgment, the word "effect" is wrongly recorded as "affect".

These are absolutely typographical errors which lost sight of the Court at the time of correction of the judgment before delivery. Therefore, this Court is of the opinion that the above typographical errors are to be rectified in the judgment itself. The corrected judgment shall be kept with the record and the same will be uploaded in the server deleting the old judgment dated 17th August, 2023 where such typographical errors have cropped up.
