Affidavit of service filed on behalf of the applicantpetitioner is taken on record. 2.

This is an application for restoration of the writ petition by recalling the order of dismissal upon condonation of delay in filing the restoration application.

By order dated 27th June, 2023, the writ petition being WPA 7024 of 2023 was dismissed for default. 4.

Mr. Goutam Dinda, learned Advocate appearing on behalf of the applicant-petitioner submits that due to non-appearance of the learned Advocate-on-record for the petitioner, the writ petition was dismissed for default. He seeks for restoration of the writ petition upon recalling the order of dismissal on condonation of delay in filing the application for restoration.

Ms. Iti Dutta, learned Advocate representing the State-respondent leaves the matter to the discretion of this Court.

Upon going through the averments made in the applications, it is found that cause shown is sufficient to restore the writ petition by recalling order of dismissal upon condonation of delay in filing the application for restoration.

Accordingly, order of dismissal dated 27th June, 2023 is recalled.

8.

The writ petition being WPA 7024 of 2023 is restored to its original file and number.

9.

The applications being CAN 2 of 2024 and CAN 1 of 2024 stand disposed of.
