This revisional application was preferred for expeditious disposal of G.R. Case No.10 of 2015. In view of the fact that the case is pending for more than eight years and the accused persons are enjoying the time being stretched without evidence progressing, I direct that the learned Judicial Magistrate, Bidhannagar will, if required, split up the case against the accused persons who are absconding after exhausting the process of law. The whole process must be completed within three months from the next date so fixed. Thereafter the learned Magistrate would fix a schedule consisting of three dates and fix such schedule each and every month so that trial of the case can be taken to its logical conclusion within a reasonable period of time. If any witness is reluctant to appear, notice be issued upon the Inspector-in-Charge/Officer-in-Charge of Lake Town Police Station who would submit a report before the court regarding the availability of the witness or the reluctance of the witness to appear.

Learned Judicial Magistrate would in case find that there is an attitude of not submitting the report within time, impose cost upon the concerned officer who is directed to submit a report for the purposes of availability of the witnesses.

Learned public prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the dates so fixed for examination of the witnesses.

All stakeholders would cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, the revisional application being CRR 1037 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
