Mr. Sushanta Rakshit Mr. Khairul Alam ....For the Petitioner Mr. Nilotpal Chatterjee Mr. Suddadev Adak ....For the alleged contemnors This is a contempt proceeding arising from an order dated January 3, 2025, the compliance report filed by the alleged contemnor no. 1 in the form of affidavit shows that the reasoned order dated February 21, has duly been communicated to the petitioner by a forwarding letter dated September 11, 2025 at pages 10 and 11 to the compliance report.

After considering the submissions made by Mr. Sushanta Rakshit, learned advocate appearing for the petitioner, it appears to this Court that the petitioner is now willing to challenge the veracity, correctness and worthiness of the said reasoned order dated February 21, 2025, this, in the firm view of this Court is not permitted in the contempt

jurisdiction. In the contempt jurisdiction the Court will see whether there has been any willful or deliberate violation of the direction of this Court. Since, the reasoned order dated February 21, 2025 has already been communicated to the petitioner, this Court is of the view that there is no contempt though the order has been communicated after three years. The direction of this Court has been substantially complied with. However, if the petitioner is aggrieved with the veracity, correctness and worthiness of the reasoned order dated February 21, 2025, he may avail of the proper recourse of law to the challenge the same, if so advised.

In view of the above, WPCRC 125 of 2025 stands dropped and closed.

Rule, issued stands discharged.

The application WPCRC 125 of 2025 stands disposed of, without any order as to costs.
