Matter is heard in presence of the learned advocates representing the petitioner and the State respondents.

Since petitioner was an employee under State Government it is found that petitioner ought to have filed original application before the West Bengal Administrative Tribunal.

This Court does not have jurisdiction at this stage to consider the grievance of the petitioner.

As the writ petition is not entertained same stands dismissed.

5.

However, this order shall not preclude the petitioner to approach West Bengal Administrative Tribunal on the selfsame cause of action.
