Banerjee) Mr. Arnab Dutt ...for the petitioner Learned advocate for the petitioner submits that through inadvertence this application under Article 227 of the Constitution of India was filed in the civil jurisdiction instead of criminal jurisdiction. He prays for leave to withdraw this application with liberty to file it afresh on the self-same cause of action. In the light of such submission CO 1080 is dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law on the self-same cause of action.

Petitioner is permitted to take back the certified copy of the order impugned by replacing the same with a Photostat copy thereof.
