Ct. No.17 that the order passed by His Lordship Hon'ble Justice Debangsu Basak in W. P. 29665 (W) of 2013 and other matters on 18th March, 2016 has been complied with as it has been pointed out by the learned advocates for the Respondent State and the District Primary School Council, Purba Medinipur that in the said matter i.e. W. P. 29665 (W) of 2013 a contempt application was taken out which was later disposed of as the order was complied with. The contempt application was dismissed on 4th August, 2017. In the said order the Principle Secretary, Education Department, Government of West Bengal was directed to undertake an investigation into the panel prepared for the subject selection process to find out if any

panelist is a relative of any member of the Selection Committee. From the record of the said contempt application being CPAN 179 of 2017 which was called for by this court on 09.08.2023 it is found that there is an enquiry report. If there is already an enquiry, no further enquiry is required to be done de novo on the self-same cause of action. Therefore, the enquiry which has been started by order of this court again because of some misunderstanding between the advocate and the client of the present writ application being WPA 6532 of 2022 need not be continued. Place this matter at 3 p.m. as I want to hand over copies of the said enquiry report to the appearing parties, which is being done now.

The parties are directed to come at 3 p.m. for making their submission in respect of the report when further orders will be passed in this matter. (Abhijit Gangopadhyay, J.)
