Banerjee) Mr. Animesh Das ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the husband and is directed against an order dated August 21, 2024 passed by the learned Additional District Judge, 3rd Court at Alipore in Misc. Case No. 240 of 2021 arising out of Matrimonial Suit No. 2066 of 2019. By the order impugned the miscellaneous case filed by the wife/opposite party herein under Order 9 Rule 13 of the Civil Procedure Code, was allowed.

After some arguments Mr. Das, learned advocate for the petitioner, submits that a direction be passed upon the learned trial judge to dispose of the Matrimonial Suit No. 2066 of 2019 expeditiously. Mr. Das, submits that the wife/opposite party has entered appearance in the matrimonial suit and has also filed written statement.

In the light of the submissions made by the learned advocate for the petitioner, CO 1081 of 2025 is disposed of by requesting the learned Additional District Judge, 3rd Court at Alipore to make an endeavour to see that the Matrimonial Suit No. 2066 of 2019 is disposed of as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
