Learned advocate, Mr. Prasun Kumar Datta along with Mr. N. P. Agarwala are present on behalf of the State. It appears from the order dated 2nd May, 2012 that a coordinate Bench of this Court directed the trial court to dispose of the case being Case No.C/723 of 2004 expeditiously. However, the instant CRM was kept pending. Since 2012 the petitioner did not take any action to get the instant criminal motion heard by this Court. In view of such conduct of the petitioner, it appears that the petitioner is not interested to proceed with the instant criminal motion and accordingly, the instant criminal motion is dismissed for non-prosecution.
