The State of West Bengal Mr. Dhananjay Banerjee Ms. Oindrila Ghosh .....for the petitioner Mr. Gourav Das ...for the State This is an application under Article 226 of the Constitution of India praying for a direction upon the police authorities as to why the respondent authorities did not consider the representation made by the petitioner on 29.03.23.

Affidavit-of-service filed on behalf of the petitioner is taken on record.

Despite service on one appears on behalf of the private respondent although the State is represented.

A copy of the report filed by the State is taken on record.

A copy of the same is handed over to the learned counsel for the petitioner.

Learned counsel appearing for the petitioner submits as follows. The petitioner is about 60 years old. The property was purchased by her husband in her name. She is living at her property with her son, daughterin-law and daughter. Her daughter is a civic volunteer. All these persons have been harassing and torturing the petitioner in one way or the other. The eldest son who stays outside maintains the mother. Yet, the private respondent even do not allow eldest son to enter the residence. Several complaints were made to the police in this regard, but no effective steps have been taken by them.

Learned counsel appearing for the State relies on the report, which is taken on record, and submits as follows. There is a long standing property dispute between the petitioner and the private respondents. On the complaints made by the petitioner several steps have been taken by the police authorities. Two proceedings was initiated under Section 107 of the Code.

Thereafter a specific criminal case has been started being Jagaddal Police Station case No. 255/22. The same is being investigated.

I have heard the submissions of the learned counsel appearing for the petitioner and

State and have perused the writ petition and the report filed by the State.

As appropriate steps have been taken by the police authorities in respect of complaints made by the petitioner, there is no need to pass any further order.

Accordingly, the writ petition is disposed of without any order as to costs.

However, the respondent police authorities shall maintain peace and keep vigil over the locale and ensure that no untoward incident happens therein.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
