In the matter of : An application under Section 482 of the Code of Criminal Procedure, 1973.

Mr. Kaushik Gupta, learned advocate appears on behalf of the opposite party/wife.

The subject-matter of the revisional application is the Order dated 9th September, 2016 passed by the learned Additional District & Sessions Judge, Fast Tract Court No-3, Barasat, North 24 Parganas in Criminal Revision No. 140 of 2014. As per the observations made in the other revisional application being CRR 3870 of 2016, the learned Magistrate and the party would be bound by that. As such, no further order is required to be passed in this revisional application and the same is deemed to be disposed of.

Accordingly, CRR 828 of 2017 is disposed of with the directions that the learned Magistrate would follow the order passed in CRR 3870 of 2016.

Department is directed to communicate this order to the learned Additional District & Sessions Judge, Fast Tract Court No-3, Barasat, North 24 Parganas as well as to the learned Judicial Magistrate, 2nd court, Barasat, North 24 Parganas.
