Banerjee) Mr. Dyutimoy Paul ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division) 2nd Court at Basirhat to dispose of Title Suit No. 3 of 2001 expeditiously.

Learned advocate for the petitioner submits that evidence of the plaintiff has been closed and the evidence of defendants' witness no. 1 had already started.

At this stage an application for appointment of a Handwriting Expert was filed by the defendants and the same stood allowed. Thereafter, the learned trial Judge fixed January 17, 2025 awaiting report from the Handwriting Expert.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite parties. However, the

petitioner shall be obliged to serve a copy of this application, along with this order, upon the opposite parties or the learned advocate representing the opposite parties before the learned trial Judge. Considering the fact that the suit is of the year 2001, CO 1084 of 2025 is disposed of with the hope and trust that the learned trial Judge shall make an endeavour to see that the report from the Handwriting Expert reaches the Court at the earliest. Immediately after receipt of the said report, the learned Civil Judge (Jr. Division) 2nd Court at Basirhat shall make all endeavours to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
