1. Petitioner contends statements of witnesses before police do not implicate him. He prays for bail.

2. Learned lawyer for the State opposes the bail prayer.

3. We have considered the materials on record. Petitioner is named in the FIR. His name also transpires in the statements of witnesses before magistrate. Petitioner and others had assaulted one Shunnath Sk and Zahidul Sk. They shared common intention with the principal accused Sofikul and Mafikul to commit the murder. Bail prayer of co-accused viz Abul Sk. and Samed Sk have also been turned down.

4. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.

5. Accordingly, prayer for bail is rejected.
