A direction to secure expeditious disposal of an application for temporary injunction is the ultimate relief sought for in this case.

Mr. Abhijit Ray, learned advocate appearing for the petitioner/plaintiff submits that prayer for injunction was filed on 17th January, 2022, and thereafter as many as four dates went adjourned on the prayer of the opposite parties/defendants.

Admittedly the opposite parties/defendants are caveators to the injunction application. The next date is submitted to be fixed on 29th April, 2022.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary.

The service upon the opposite party is thus dispensed with, so far as the present revisional application is concerned.

Accordingly learned 10th Bench, City Civil Court, Calcutta in Title Suit No. 107 of 2022 is requested to ensure expeditious disposal of the pending injunction application, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, on the mere asking of defendants without being objectively satisfied, unless it is extremely unavoidable.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties as well.

With this observation and direction, the revisional application stands disposed of.
