"It appears that the petitioner, the mother of Respondent No.
4, seeks a separate electricity connection for the portion of the premises currently under her occupation. However, the learned advocate representing the son asserts that the mother occupies only one room and that both the son and the mother reside together. Consequently, he argues that there is no need for a separate electricity connection for the mother.
Mr. Nilotpal Chatterjee, learned advocate, is requested to represent the State in this matter. The petitioner is directed to serve a copy of the writ petition upon Mr. Nilotpal Chatterjee.
The Officer-in-charge of Charu Market Police Station is directed to file a report in response to the allegations made in this writ petition within seven days from the date of this order. The Police shall inspect the premises and submit the report accordingly.
Further, CESC is also directed to file a report within seven days from the date of this order. This matter is listed to be heard again after seven days, under the same heading."
Pursuant to the said order, both the police and the Calcutta Electricity Supply Corporation Limited (CESC) have submitted their respective reports. From the police report, it appears that the premises in question comprise a two-storied building. At present, the petitioner's mother occupies one room on the ground floor. The report further indicates that renovation work is being undertaken in respect of another room on the ground floor.
Respondent nos. 4 and 5-the son and daughter-in-law of the petitioner-reside on the first floor. Unfortunately, the relationship between the petitioner and respondent nos. 4 and 5 appears to be strained, which may have led the petitioner to file the present writ petition seeking a separate electricity connection.
Learned counsel appearing for respondent nos. 4 and 5 submits that an existing electricity connection is already in place and that the petitioner has been availing electricity from that connection.
CESC submits that the petitioner has already deposited the requisite charges for obtaining a separate electricity connection.
In view of the undisputed possession of the petitioner's mother on the ground floor, I find no justification to deny the prayer for a separate electricity connection, particularly since
CESC has expressed its willingness to provide the same. Accordingly, CESC is directed to effect a separate electricity connection in favour of the petitioner within a period of three weeks from the date of this order. The connection shall be provided from the existing meter board location.
The Officer-in-Charge, Charu Market Police Station, is directed to extend necessary assistance to the officials of CESC for implementation of this order. The costs associated with police assistance shall be borne by the petitioner. The police shall also be at liberty to break open the padlock of the meter room, if required, to facilitate the connection. It is, however, clarified that the grant of a separate electricity connection shall not confer any right, title, or interest upon the petitioner with respect to the property in question.
Accordingly, WPA 6846 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
