Learned advocate for the petitioners submits that the petitioner no.1 has already been taken into custody. Accordingly, the application for anticipatory bail is dismissed as not pressed as far as the petitioner no.1 namely Suroj Sk. is concerned.

Learned advocate says that the petitioner no.2 has no direct complicity in the alleged incident. Investigation is over

and charge-sheet has been submitted.

Custodial interrogation of the petitioner no.2 may not be necessary. We have seen the statements of witnesses recorded under Section 161 of the Code of Criminal Procedure. We have seen the Injury Report. The victim suffered multiple injuries on his face. Sharp cutting weapon was used. The petitioner's name appears in several statements of witnesses. Considering the nature and gravity of the charge, although charge-sheet has been submitted, we are not inclined to allow the prayer for anticipatory bail of the petitioner no.2 namely Sadhan Biswas.

Accordingly, CRM 2790 of 2021 is dismissed.
