The petitioner is aggrieved that her application for transfer has been rejected on the ground that she is the only teacher (single teacher) for the subject Physical Education being taught in the School. It is now well settled that in terms of the Notification dated 3rd January, 2022, even a single teacher in a subject is entitled to apply for transfer and the same is liable to be considered by the concerned District Inspector of Schools (SE) in consultation with the CSE.

The petitioner shall therefore be entitled to make an application afresh through the Utsashree Portal. The head of the School shall forward the said application to the concerned District Inspector of Schools, for further action strictly in terms of the

Circular dated 3rd January, 2022. The DI of Schools (SE), Malda, shall consider the petitioners application within a period of six weeks from the date of communication of a copy of this order.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
