Learned advocate appearing for the petitioner submits that the petitioner in custody for 78 days, charge-sheet has already been submitted and petitioner being the owner of the vehicle has been implicated because of fault of the driver and other employees. Learned advocate further submits that petitioner did transfer his vehicle to some other person. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the vehicle being intercepted the driver fled away and till date he is absconding; proclamation is pending against the said accused. The petitioner himself was also absconding for a considerable period of time and has been subsequently arrested.

Having regard to the quantum of seizure in the present case which is 3900 bottles of Phensedyl and the conduct of the accused person, I am not inclined to grant bail to the petitioner. As such, the prayer for bail of the petitioner is rejected.

The application for bail, being CRM (NDPS) 560 of 2026, is, thus, dismissed.
