Ms. Arpita Paul Biswas ... for the petitioner Mr. Srijan Nayak ... for the WBSEDCL The grievance of the petitioner is directed against refusal of the WBSEDCL to shift the transformer situated adjacent to the premises of the petitioner.

On behalf of WBSEDCL, it is submitted that the transformer was installed decades ago after compliance of all statutory formalities. The writ petition has been pending since 2021. It appears from the Report filed by WBSEDCL that there is no way leave even suggested for the proposed location of the transformer. The area is a highly congested and there is no alternative area where such transformer can be shifted. In any event, there is no inconvenience being caused to the petitioner. There is no enforceable legal right, which the petitioner has been able to demonstrate as to why the subject transformer be shifted. There is also no alternative proposal for such shifting of

such transformer. In addition, there is gross and inordinate delay in the filing of the writ petition. In view of the above, WPA 7808 of 2021 stands dismissed.
