07.04.2025 Court No.28 Item No.23 ssi CRM (A) 1047 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Ratua P.S. Case No.540 of dated 01.10.2024 under Sections 103(1)/238(a)/3(5)/61(2) of the BNS.
And In the matter of: Runa Khatun @ Mst Runa Khatun & another. ....Applicants/Petitioners.
Mr. Kallol Mondal Mr. Krishan Ray Mr. Arup Sarkar Mr. Souvik Das Mr. Anamitra Banerjee Mr. Akbar Laskar Mr. Mobaraktulla ...for the petitioners.
Mr. Bitasok Banerjee Mr. Raju Mondal ..for the State Learned senior counsel representing the petitioners submits as follows. The petitioners are the married sisters in law of the de facto complainant. Over the death of the de facto complainant's husband, she lodged an FIR alleging commission of murder and disappearance of evidence by the victim's own father, brothers and other relatives. The petitioners being married sisters in law were staying elsewhere and were in no way connected with the murder. The father of the deceased is on bail. But, the two brothers are still in custody. Learned counsel appearing on behalf of the State relies on the case diary, opposes the prayer for anticipatory bail and submits as follows. As per the statement of the daughter of the victim, immediately after she learnt about the death of her father, she went
to her grandfather's place and found the dead body at a place which was about 350 meters away. There were marks of blood in the bed room and varandah of the grandfather's house. Seeing her there, the present petitioners asked her to go away and threatened her that they would do the same thing that was done to her father if she stayed there.
In view of the materials available in the case diary, I do not think that this is a fit case to grant anticipatory bail. In view of the above, the prayer for anticipatory bail is rejected. (Jay Sengupta, J.)
