It appears to this Court that paragraph 16 of the writ petition is misconceived. The petitioner talks about the premature release of the petitioner no.1. On the other hand, the petitioner is aggrieved because the Central Board of Secondary Education has not changed the name of the petitioner from Gunjan Sinha to Kanisk Sinha. The learned advocate for the Central Board of Secondary Education submits that no prayer was made by the Central Board of Secondary Education. The Examination Bye-laws of 1995 of the Central Board of Secondary Education has been produced before the Court which deals with incorporation of changes in board's certificate. It is submitted that such request for change has to be made within 10 years from the date of issue of the documents along with certain other documents as quoted in Bye-laws 69.1.

The petitioner has all along been known as Gunjan Sinha in all his documents. He wants to change his name in the registration of the Bar Council of West Bengal. The Bar Council of West Bengal has not been made a party. Thus, no mandatory order can be passed. The petitioner may approach the Central Board of Secondary Education in accordance with law and the Central Board of Secondary Education will consider the prayer in accordance with their bye-laws.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
