24.03.2023 sdas rejected C.R.M. (NDPS) No. 488 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Raghunathganj Police Station Case No. 353 of 2020 dated 15.07.2020 under Sections 20(b) /29 of the NDPS Act.

And In Re : Mantu Mondal & Anr. ..... petitioners Mr. Sukanta Ghosh Mr. Priyankar Ganguly ... for the petitioners Mr. Ranabir Roy Choudhury Mr. Sandip Chakraborty ... for the State Learned Counsel for the petitioners submits they are in custody for two years and eight months. They pray for bail. Learned Counsel for the State opposes the bail prayer. We have considered the materials on record which shows recovery of narcotics above commercial quantity i.e. 105 kgs. of Ganja from a vehicle. Petitioners were present in the vehicle. In view of the aforesaid materials and statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioners.

The application for bail is, thus, rejected.

We request the trial court to conduct the trial with utmost expedition and conclude the same at an early date preferably within one year from the next date fixed for recording

evidence without granting unnecessary adjournment to either of the parties.
