Mr. Chatterjee, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. His name has transpired on the basis of statement of co-accused persons, who were arrested and were enlarged on bail. He further submits that there is no incriminating material against the petitioner and the allegations levelled against him are absolutely unfounded. In the said conspectus, custodial interrogation of the petitioner is not necessary. Mr. Ganguly, learned advocate appearing for the State opposes the petitioner's prayer and submits that 42 live bombs were recovered and that investigation is still in progress.

Having heard the learned advocates appearing for the respective parties and considering the materials in the case diary, the statement of witnesses, as recorded under Section 161 of the Code, the gravity of the offence and the extent of complicity, we are not inclined to exercise any discretion in favour of the petitioner.

Accordingly, the application for anticipatory bail being CRM No.2797 of 2021 is dismissed.
