In terms of the order dated 6th November, 2025 a report is filed in the form of affidavit affirmed on 21st November, 2025 by the Special Revenue Officer-II of Digha Sankarpur Development Authority and same is taken on record.

On perusal of the report, it transpires that petitioner worked from 2003 to 11th April, 2022 intermittently as per requirement as daily rated Master Roll Worker in connection with electrical maintenance.

It is also averred that last date when petitioner worked was 11th April, 2022. Thereafter electrical maintenance work is carried out by Public Works Department from August, 2024. Petitioner claims continuity in service by regularizing his appointment.

In the writ petition no appointment letter is

annexed and in the report filed today it is disclosed that petitioner worked on daily rated basis intermittently as per requirement of the concerned respondent authority.

Considering the nature and engagement of the petitioner, it appears that no right accrues in favour of the petitioner warranting issuance of mandamus in order to protect such right relating to continuity in service.

In this regard reliance is placed on the judgment of the Hon'ble Supreme Court, reported in 2006 Vol. 4 SCC 1 (Secretary, State of Karnataka & Ors. -vsUma Devi (3) & Ors.) 7.

Hence, no relief can be granted to the petitioner. 8.

The writ petition stands dismissed.

However, there shall be no order as to costs.

10. Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
