S/L 413(ML) 13.07.2022 Court. No. 19 GB WPA 6580 of 2022 Hirak Nath Sounth VS The State of West Bengal & Ors.

Mr. Riju Ghosh, Mr. Sumitava Chakraborty.

... for the Petitioner.

Mr. Wasim Ahmed, Mr. Subhabrata Das.

... for the State.

Affidavit-of-service filed in Court today, be kept with the record. The postal articles have been returned with the endorsement 'Addressee left'.

As the petitioner is an accused in a Chit-fund case and investigation is going on by the Central Bureau of Investigation, the prayer of the petitioner for witness protection must be made before the concerned investigating authority.

The petitioner contends that Aniruddha Ghoshal and Anjan Bandyopadhyay, who were his business partners in the chit-fund business, have cheated him and committed forgery.

The Inspector-in-Charge, Kharagpur Town Police Station has filed a report, from which it appears that Aniruddha Ghosal was arrested in connection with SEBI Case No.2 of 2018 and was also produced before the learned Judge, Special Court, Kolkata. The police report is taken on record.

The issues are already sub judice before the Special Judge and central agencies are investigating. Thus, this Court is of the view that it would not be wise to direct parallel proceedings. The grievances of the petitioner can be addressed by the concerned investigating agencies as also by special court.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
