BALAI CHANDRA PURKAIT Mr. Lakshminath Bhattacharya ..for the petitioner By this revisional application, the defendant no.1/petitioner has prayed for expeditious disposal of an application filed for repairing of the house in his possession in connection with Title Suit No.278 of 2018 pending before the learned Civil Judge, Senior Division, Diamond Harbour, District South 24 Parganas.

This is a suit for declaration and injunction. It is submitted that the said application was filed when the premises in occupation of the defendant no.1/petitioner had been damaged due to cyclone 'Amphan'.

It is submitted that the said application has been pending for long. It is also submitted that the copies of the repairing application have been served upon the opposite parties but the opposite parties had not filed the written objection as yet.

Under such circumstances, for the ends of justice, this revisional application is disposed of with a direction upon the learned Court below to dispose of the application for repairing as early as possible preferably

within a period of two months from the next date fixed upon allowing the parties to contest the same by filing their respective written objections.

This revisional application is disposed of.

The petitioner is directed to serve copies of the revisional application along with server copy of this order upon the opposite parties and/or their learned Advocate in the court below within a week from date.

There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
