Ms. Ipsita Banerjee ... ... for the respondent no.5 Mr. Kaustav Banerjee ... ... for the intervenor This intra-court appeal at the instance of the appellant (writ petitioner) challenging the order of the learned Single Judge dated 4th March, 2022 whereby the writ petition has been dismissed mentioning that the petition was otherwise abuse of the process of the law. The appellant is claiming himself to be the son of late Asim Kumar Das who is stated to have died on 24th May, 2021 and survived by his wife and two sons including the appellant. The appellant wants certain information from the respondent/bank and the income tax authorities. Due to non-supply of the same he had approached the Writ Court and the writ petition has been dismissed.
So far as the respondent no.2/bank is concerned, learned counsel appearing for the bank has submitted that if the appellant furnishes copy of the Voter Card, PAN Card and Aadhar Card/Passport then the requisite details of the bank account of his father will be supplied to the appellant. This duly takes care of the grievance of the appellant as against the respondent no.2/bank. So far as the grievance of the appellant as against the respondent no.4/income tax department is concerned, the order passed by the learned JM, 5th Court has been filed along with CAN 1 of 2022 which adequately redresses the grievance of the appellant. That apart, one of the learned counsel has appeared on behalf of the mother and brother of the appellant and has opposed the other prayers made in the petition but he has no objection if the requisite information relating to bank account is supplied to the appellant.
In these circumstances, we dispose of the present appeal by modifying the order of the learned Single Judge to the extent indicated above.
The appeal and the connected applications are accordingly disposed of.
