Teacher-in-Charge of Kolia Amir Ali High School (HS) (hereinafter referred to as the "said school) has approached this Court with the present writ petition for filling up the available vacancies of Assistant Teacher.

It is submitted by the learned advocate representing the petitioner that in the said school at present twenty four teachers are working but sixteen posts of Assistant Teacher in Upper Primary section and three posts of Assistant Teacher in Higher Secondary section are lying vacant.

Petitioner has prayed for authentication of vacancies under 100 Point Roster by the District Inspector of Schools (SE), Howrah for filling up the

existing vacancies.

Bhattacharyya, learned advocate representing the West Bengal Board of Secondary Education has submitted that in terms of the existing norms at present vacancy position is not authenticated as per 100 Point Roster by the District Inspector of Schools (SE) concerned but it is done by the Backward Classes and Welfare Department on reference being made by the concerned authority of the West Bengal Board of Secondary Education.

According to the respondent authorities including the Board said school authority instead of waiting for authentication of vacancies as per 100 Point Roster is required to forward the vacancy report to the District Inspector of Schools (SE), Howrah for taking necessary steps.

It is also submitted that appointments of Assistant Teachers in Upper Primary section throughout the State of West Bengal is going on based on the select list prepared by the concerned authority of the West Bengal Central School Service Commission on concluding 1st State Level Selection Test, 2016 (Upper Primary).

In view of aforesaid situation, leave is granted to the petitioner to report vacancy position of the said school to the District Inspector of Schools (SE), Howrah

being respondent no.4 by fortnight from date. On receipt of vacancy report respondent no.4 and other concerned respondents are directed to take necessary steps in accordance with law for filling up the existing vacancies available in the said school. The writ petition stands disposed of.

However, there shall be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
