The petitioner is aggrieved by the fact that the private respondent is obstructing free egress and ingress of the petitioner in spite of direction of the civil court. To that effect, learned advocate appearing for the petitioner has drawn the attention of the Court to the order dated 07.10.2024 passed in T.S. 1442/2024. Learned advocate for the petitioner further submits that information was furnished to the police authorities regarding the illegal acts of the private respondent as also the order of the civil court not being complied with. State has submitted a report which reflects that on the basis of information furnished, Sankrail Police Station Case No. 226/2025 dated 19.03.2025 has been registered for investigation under the relevant provisions of BNS.

So far as the compliance of the civil court's order is concerned, petitioner would be at liberty to take out appropriate application before the learned Civil Judge (Junior Division), 5th Court, Howrah. If any direction is passed upon the police authorities for rendering assistance, police authorities would respect, obey and implement such order.

In the meantime, the police authorities would keep a strict vigil and ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the strained relationship existing between the petitioner and the private respondent.

With the aforesaid observations, the writ petition being WPA 6923 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
