This revisional application seeks expeditious disposal of Title Suit No.437 of 2022 pending before the Learned Civil Judge (Senior Division), 10th Court at Alipore, South 24-Parganas along with the connected applications.

Learned Advocate appearing for the petitioners submits that in the said suit, the opposite parties have filed an application under Order 7 Rule 11 of the Code of Civil Procedure, 1908 to which, the petitioners have already filed their objection but the same is pending. It is further submitted that the petitioners have also filed an application under Order 26 Rule 9 of the Code. The same is also pending.

Having regard to the nature of the order proposed

to be passed, direction for prior service of notice on the opposite parties is not being made, however, the petitioners shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite parties within a week from date.

Having heard the learned Advocate appearing for the petitioners and having perused the materialon-record, this revisional application is disposed of by requesting the Learned Civil Judge (Senior Division), 10th Court at Alipore, South 24Parganas to dispose of the application under Order 7 Rule 11 of the Code of Civil Procedure as expeditiously as possible and preferably within a period of two months from the next date fixed. Thereafter, the learned Trial Court is requested to dispose of the application under Order 26 Rule 9 of the Code as expeditiously as possible and preferably within a period of two months thereafter. The learned Trial Court is further requested to expedite the hearing of the suit and dispose of the same as expeditiously as the business of the learned Trial Court would permit, without granting unnecessary adjournment to either of the parties.

CO 1060 of 2026 stands disposed of with the above observations. No costs.

applied for, be supplied to the parties subject to compliance with all requisite formalities.
