Record of this revisional application reflects that Durgapur P. S. Case No. 361 of 2006 dated 04.12.2006 was registered almost 16 years ago.

Learned advocate appearing for the petitioner submits that there are hardly any allegations so far as the present petitioner are concerned and he has been falsely implicated at the instance of his sister-in-law. It has also been submitted that the petitioner was in the Army, as such was unaware regarding the criminal proceedings or its progress. So he could not take steps immediately. Mr. Sur, learned Additional Public Prosecutor submits that the Investigating Agency after completion of investigation submitted chargesheet before the jurisdictional court.

The present application for quashing was preferred for further

delaying the case.

I have considered the submissions advanced by the learned advocate for the petitioner as well as the learned advocate for the State. Having regard to the time, which has elapsed since the initiation of the present case, I am of the opinion that at this belated stage there is no scope for interference.

The petitioner will be at liberty to produce necessary documents and/or canvass the points regarding the merits of the case so far his complicity is concerned at the stage of Section 239/240 of the Code of Criminal Procedure.

With the aforesaid observations, the present revisional application being CRR 842 of 2021 is disposed of. . Pending applications, if any, are consequently disposed of.
