This revisional application seeks expeditious disposal of an application for injunction under Order 39 Rule 1 and 2 of the Code of Civil Procedure filed by the opposite party along with an application seeking vacating of the interim order of injunction filed by the petitioner in connection with Title Suit No. 1053 of 2025 pending before the learned Civil Judge (Senior Division), 5th Court at Alipore, District- South 24 Parganas.

Learned Advocate appearing for the petitioner submits that neither the application for injunction is being disposed of nor the application for vacation of the interim order has been heard out. It is also submitted that the petitioner has been suffering an order of injunction and the application seeking vacation thereof has been kept pending.

Having regard to the nature of the order proposed to be passed, direction for prior service of notice on the opposite party is not being made, however, the petitioner shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite party within a week from date.

Having heard the learned Advocate appearing for the petitioner and having perused the materialon-record, this revisional application is disposed of by requesting the learned Civil Judge (Senior Division), 5th Court at Alipore, South 24-Parganas to dispose of the application for injunction under Order 39 Rule 1 and 2 of the Code filed in connection with Title Suit No.1053 of 2025 together with the application for vacating of the interim order filed in the said suit as expeditiously as possible and preferably within a period of three months from the next date fixed without granting unnecessary adjournment to either of the parties. 5.

CO 1062 of 2026 stands disposed of with the above observations. No costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
