The petitioner seeks for a direction upon the District Inspector of Schools (Secondary Education), Paschim Medinipur seeking release of his monthly salary on and from February 2024.

The District Inspector of Schools (Secondary Education) has filed a report before this Court wherefrom it appears that the District Inspector of Schools has intimated the Principal Secretary, School Education Department regarding the illegal activities in respect of appointment of teaching and nonteaching staff in a Christian minority school.

According to the District Inspector of Schools, there has been misuse of Government fund.

The District Inspector of Schools mentions that the petitioner is not rendering service in the school. 4.

The aforesaid submission of the District Inspector of Schools is denied by the learned advocate representing the school authority.

A criminal case against the petitioner is reported to be pending consideration with charge-sheet filed. 6.

The Court is of the opinion that there are disputed question of facts which cannot be decided by the writ court.

As the District Inspector of Schools has already drawn the attention of the Principal Secretary in this regard, accordingly, the instant writ petition stands disposed of directing the Principal Secretary, School Education Department to look into the matter and find a solution of the problem that has been cropped up. 8.

An opportunity of hearing shall be granted to the petitioner, the school authority and the representative of the District Inspector of Schools for arriving at a proper decision in the matter.

The Principal Secretary shall take steps at the earliest but positively within a period of twelve weeks from the date of communication of this order.

10. A reasoned order shall be passed by the Principal Secretary and communicated to all the parties immediately thereafter.

It is made clear that all points are left open to be decided by the Principal Secretary upon giving hearing to the parties.

12.

Certified copy of this order, if applied for, shall be made available to the parties.

13. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
