1. Affidavit of service filed on behalf of the petitioner is taken on record.
2. Mr. Chatterjee, learned advocate representing the petitioner submits that in spite of order passed by a Co-ordinate Bench on 21st August 2025 on a previous writ petition being WPA 18831 of 2025 till date charge sheet has not been filed. However, in reference on a document at pages 23 and 24 of the writ petition it is submitted that a communication was made by the investigating officer of criminal prosecution being Belghoria P.S case no. 457 dated 21.9.2023 informing the petitioner that the FIR named person was apprehended on 6th September 2025 and police remand was allowed for a period of five days. Based on the leading statement of the said arrested accused, several raids were conducted under jurisdiction of Dum Dum police station. Confessional statement of the arrested accused was also recorded. Notices were also sent to the
concerned bank authorities to provide details of certain accounts.
3. From the communication dated 21st September 2025 of the investigating officer it is found that investigation is still continuing.
4. Today Mr. Yusuf, learned Additional Government Pleader representing the state respondents submits that by one month investigating officer shall file report before the jurisdictional magistrate.
5. Considering the submissions made on behalf of the state respondents and taking note of the steps taken by the police authority as it emanates from the aforesaid communication dated 21st September 2025, this Court directs the investigating officer of Belghoria P.S case no. 457 dated 21.9.2023 to submit report before the jurisdictional magistrate by four weeks from date.
6. The writ petition stands disposed of.
7. Communication dated 29th March 2026 of Officerin-Charge, Belghoria Police Station is filed today and the same is taken on record.
8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
