The School Service Commission is represented.

It is submitted that in the choice of the schools already indicated by the petitioner in his application for transfer, the petitioner's rank is below other candidates who are on priority.

In that view of the matter, this Court directs the Chairman, School Service Commission to sit with the petitioner on July 13, 2023 at 2 p.m.

The petitioner, prior to that, shall indicate a fresh choice of three schools, to the School Service Commission through Dr. Patra.

5.

The Commission may, in the meantime, ascertain the rank and status of the petitioner vis-à-vis any other existing candidates who have chosen those schools.

6.

Appropriate communication shall be made by the Commission with the petitioner and/or his learned Advocate.

7.

Let appropriate orders of transfer to an available school in accordance with law be effected by the School Service Commission and communicate the same for onward action to the West Bengal Board of Secondary Education.

8.

It is made clear that the concerned District Inspector of Schools shall extend urgent and immediate co-operation of the Chairman of the School Service Commission, to ensure effective and smooth compliance of the aforesaid order.

9.

The entire aforesaid exercise shall be carried out offline by the School Service Commission, the District Magistrate and the WBSE.

10.

With the aforesaid observations, the contempt application shall stand disposed of. Rule, if any, shall stand discharged.

11.

There shall be no order as to costs.

12.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
