Petitioner has filed this writ petition being aggrieved by the alleged inaction on the part of the respondent Income Tax authority concerned/Commissioner of Income Tax (Exemption) in considering and finally disposing its application dated 20th March, 2019 being annexure P/9 to the writ petition.

Mr. Dutt, learned advocate representing the respondent Income Tax authority submits that the appropriate authority for consideration of the application in question is CBDT and the CIT concerned has already referred the matter to the CBDT and the appropriate direction may be passed upon CBDT/respondent No. 2.

Considering the facts and circumstances of this case and submission of the parties and without going into the merit of the aforesaid application, this writ petition being WPA 7533 of 2024 is disposed of by directing the respondent No. 2/CBDT to consider and dispose of the aforesaid application of the petitioner dated 20th March, 2019 in accordance with law and by passing a reasoned and speaking order after giving opportunity of hearing to the petitioner or its authorised representatives, within a period of eight weeks from the date of communication of this order.
