Heard learned counsels for the parties.

The petitioner claims to be entitled to the compensation assessed by the railway authorities and denies and disputes the similar claim made by the 5th respondent. Since both the petitioner and the private respondent claim to be interested in the amount of compensation assessed by the railway authority and there is also dispute with regard to apportionment, if any, of the said amount, the Additional District Magistrate (LA), Paschim Bardhaman has referred the matter to the Court of the learned District Judge, Paschim Bardhaman under Section 20H of the Railways Act, 1989 for consideration. Since the matter is pending consideration before the learned District Judge, Paschim Bardhaman, the learned

District Judge, Paschim Bardhaman is requested to consider and dispose of the matter as expeditiously as the business of his Court would permit, preferably within a period of three months from the date of communication of this order, in accordance with law.

With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
