W.P.A. 7868 of 2021 (Sukumar Mondal vs. State of West Bengal & Ors.) Mr. Mitul Chakraborty .... For the Petitioner Mr. Susovan Sengupta Mr. Srikanta Paul .... For the State The petitioner complains that the private respondents have raised construction by encroaching upon public highway and have thereby obstructed his egress and ingress. Though demand for removal of such illegal construction was forwarded to the State respondents, through learned counsel for the petitioner, no application to that effect was filed by the petitioner himself.

Learned counsel for the State submits that in the event the petitioner files such an application to that effect before the respondent No. 4, such application shall be disposed of expeditiously.

Accordingly, I dispose of the writ petition with liberty to the petitioner to file an

application ventilating his grievance before the respondent No. 4 within two weeks from date. The respondent No. 4 shall dispose of the said application after granting opportunity of hearing to all the affected parties including the petitioner within a period of three months from the date of receipt of application, in accordance with law.

W.P.A. 7868 of 2021 is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of this order, if applied for, be given to the parties on compliance of requisite formalities.
