Petitioner prays for bail.
Learned advocate appearing for the petitioner submits that one of the co-accused was enlarged on bail by the jurisdictional court. The petitioner was falsely implicated. He submits that the petitioner is in custody for 178 days. The police filed charge-sheet and, therefore, further detention of the petitioner is not required.
Learned advocate appearing for the State draws the attention of the Court to the statement of the victim recorded under Section 164 of the Criminal Procedure Code, the Medical Examination Reports of the victim and the petitioner.
Considering the Medical Examination Reports of the victim and the petitioner and considering the statement of the victim recorded under Section 164 of the Criminal Procedure Code, we are unable to enlarge the petitioner on bail.
Accordingly, the prayer for bail of the petitioner is rejected. C.R.M. (DB) 984 of 2022 is dismissed.
