On the death of one of the partners of the partnership firm, the oil company is allowing the dealership to continue till July 8, 2021. The oil company is yet to take a decision as to the continuance of the dealership thereafter.

Learned advocate appearing for the oil company submits that, the dealership is valid till July 8, 2021 notwithstanding the death of partners of the partnership. He submits that, the parties are to satisfy the oil company as to the reconstitution of the partnership. In the event the oil company is satisfied with the reconstitution of the partnership, the oil company would take appropriate decision in accordance with law with regard to the continuance of the dealership.

In such circumstances, it would be appropriate to direct the respondent no.3 to decide the fate of the dealership in accordance with law after affording the petitioners a reasonable opportunity of hearing. It is expected that such decision be taken within a period of two weeks from date. The respondent no.3 shall communicate its decision to the parties within two weeks thereafter.

W.P.A. No.7881 of 2021 is disposed of, accordingly.
