Heard counsel appearing on behalf of the parties. This writ petition has filed challenging the notices dated 01.10.2007 and 04.3.2008 both issued by the respondent no.1 being Annexures P/5 and P/10 of the writ petition.

It is to be noted that these are notices that were issued with regard to the erstwhile owners for the period of 20032004. Mr. T.M. Siddiqui, counsel appearing on behalf of the State-respondents has tried to get instruction from the client but unfortunately fails in doing so as the client does not get touch with him.

In light of the same, following the doctrine of non traverse this Court allows the writ petition and quashes the notices dated 01.10.2007 and 04.3.2008.

With these observations, WPA 4908 of 2008 is disposed of.

There will be no order as to costs.
