1. Parties are represented through their respective learned counsel.

2. Heard on admission.

3. The order dated 18.02.2026 passed in Misc. Case No. 61 of 2026 is under challenge, which was passed in a proceeding under West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962.

4. Learned senior counsel for the writ petitioners in his usual fairness informed that this order can be called in question by preferring an appeal under section 7 the aforesaid Act.

5. Other side has no objection.

6. Since petitioners have a statutory, alternative efficacious remedy available, we are not inclined to entertain this PIL.

7. PIL is disposed of by reserving liberty to the petitioners to avail the said remedy.

8. It is made clear that petitioners will be at liberty to raise all possible grounds in the appeal.

9. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
